NOTICE IS HEREBY GIVEN that the Regular meeting of the Otoe County Commissioners of Otoe County, Nebraska, will be held at 8:30 A.M. on May 13, 2008, in the County Courtroom (108) of the Otoe County Courthouse at Nebraska City.  The meeting will be open to the public.  An agenda for such meeting is kept continuously current, and is available for public inspection at the office of the County Clerk at the Courthouse, but the agenda may be modified at such meetings to include items of an emergency nature only.

May 13, 2008

 

The Otoe County Board of Commissioners convened in regular session at 8:30 a.m. on May 13, 2008 to audit and sign payroll claims and regular claims and to take care of such other matters as are on the agenda for this meeting.  Advance notice of this meeting was published in the Nebraska City News Press and Syracuse Journal Democrat, announced on the local radio station KNCY and posted in at least three public places. This meeting was open to the Public, and the agenda was kept current, and is on file for public inspection at the office of the Otoe County Clerk during regular business hours.

 

The meeting was called to order by the Chairman of the Board, Dale Haverty. Answering present at roll call were Commissioner Haverty and Commissioner Schroder. Commissioner Thummel was absent.

 

Chairman Haverty informed the public in attendance that a current copy of the Open Meetings Act is posted on the south wall of the Courtroom.  Additional copies are available upon request. He asked that all attendees turn off their cell phones or set them to vibrate while present in the meeting room.

 

Commissioner Schroder made a motion, seconded by Commissioner Haverty to accept the agenda as posted. Voting -- Commissioners Haverty, aye; Schroder, aye. Motion carried.

 

Commissioner Schroder made a motion, seconded by Commissioner Haverty to accept the minutes from the previous meeting as mailed to them as each member was furnished with a copy of same. Voting – Commissioners Schroder, aye; Haverty, aye. Motion carried.  

 

Commissioner Schroder made a motion, seconded by Commissioner Haverty to audit and sign payroll claims and regular claims unless otherwise noted. Voting – Commissioners Haverty aye; Schroder, aye.  Motion carried.

 

Therese Trombino, Deputy County Assessor, presented the following tax list correction.  Cecil L Neil – add $2,894.60 for tax year 2007 – state disallowed the Homestead exemption.  Commissioner Schroder made a motion to approve the tax correction, seconded by Commissioner Haverty.  Voting – Commissioner Haverty, aye; Commissioner Schroder, aye.  Motion carried.

 

Janis Riege, District Court Clerk, presented a request to purchase additional shelving units for her vault.  Ms. Riege obtained two quotes for storage shelves; both were from OSDI (Office Storage & Digital Imaging) in Omaha, the same company she purchased shelving from two years ago. One bid included a 36” unit with 15” deep shelving to hold the larger books costing an additional $200. So the quotes ranged between $1600 and $1800. She said if they were not purchased by May 16, 2008, the price would increase over $100.  She would like to order before the price increases to save some money.  Commissioner Schroder made a motion to approve purchase of new storage shelves, seconded by Commissioner Haverty.  Voting -- Commissioner Haverty, aye; Commissioner Schroder, aye.  Motion carried. Ms. Riege said she thought she would have about $1000 to spend from her budget.                      

 

Janene Bennett, Otoe County Clerk, requested the release of a pledged security with Arbor Bank, Nebraska City, in the amount of $400,000 and the deposit of a $410,000 security to replace it. These securities cover money held in the County’s Imprest Fund.  Commissioner Schroder made a motion, seconded by Commissioner Haverty to adopt Resolution 2008-21 approving said transaction.  Voting -- Commissioners Haverty, aye; Schroder, aye. Motion carried. 

 

Jackie Smith, County Treasurer, requested the following changes in pledged securities:  addition of a $500,000 pledged security with the Farmers Bank in Nebraska City; the release of a pledged security with Arbor Bank, Nebraska City, in the amount of $500,000 and replacing it with a pledged letter of credit valued at $2,000,000.  Commissioner Schroder made a motion, seconded by Commissioner Haverty to adopt Resolutions 2008-22 and 2008-23 approving said transactions.  Voting -- Commissioner Schroder, aye; Commissioner Haverty, aye.  Motion carried.

 

Glen Steffensmeier, County Highway Superintendent, Lynn Denniston, Bridge Foreman, and Wally Pohlman, Road Foreman, came before the Board to discuss road and bridge matters.  Steffensmeier presented a letter from the state of Nebraska informing him that all public bridges are required to be engineered.  All new construction and bridges that are reconstructed are required to be designed by a professional engineer.  Maintenance such as re-planking can still be done by the county without any review.   Several of the road machines have over 10,000 hours on them.  Someone from Nebraska Machinery will come out and check the machines to give an estimate on rebuilding a motor and replacing any worn parts and hoses on the machines.  A person in Douglas contacted Steffensmeier and requested permission to grade two miles of county road near his house.  This person has his own motor grader.   Glen is not in favor of allowing him to do that as there would be no way to supervise the work and we would be setting a precedent if anyone else wanted to grade another section of county road.  Commissioner Schroder and Commissioner Haverty do not feel that it would be appropriate to allow anyone other than a county employee to grade a county road.  Commissioner Schroder recommended that at least one part time person be hired to temporarily help Wally Pohlman since he is down two people and possibly three.  Glen said it should be advertised in the paper and the applicants should have a CDL.  Commissioner Schroder instructed Steffensmeier to put an ad in the paper and hire someone. 

 

At 10:00 a.m. a public hearing was held to hear support or objections for the issuance of Industrial Development Revenue Bonds for the Diversified Foods Inc project. Joe Taylor with Diversified Foods, Pat Haverty, Executive Director of RCEDC, Dave Partsch, County Attorney, and Andrew Romshek, Bond Counselor, spoke in favor of the bonds. On March 11, 2008, the County Board signed a Resolution of Intent to authorize the issuance and sale of these non-recourse bonds, not to exceed $2,500,000. Pat Haverty said Diversified Foods needs to purchase more equipment and therefore needs additional bonds.  Dave Partsch stated that there would be no bond payment liability to the County if they signed this final resolution.  Motion to sign Resolution 2008-24 authorizing the issuance and sale of Industrial Development Revenue Bonds, not to exceed $2,500,000 pursuant to a plan of financing for Diversified Foods and Seasonings Inc, was made by Commissioner Schroder and seconded by Commissioner Haverty.  Voting – Commissioner Haverty, aye; Commissioner Schroder, aye.   Motion carried. 

 

There being no further business to come before the Board at this time, and since all items on the agenda have been disposed of, Commissioner Schroder made a motion, seconded by Commissioner Haverty to adjourn the meeting, until the next one, which will be on May 27, 2008.
