Public hearing to approve W & W Damme Subdivision a 4.86 acre tract of land located in the NW ¼ of the NE ¼ of Section 35, T. 7N., R.11E., of the 6th P.M., Otoe County, Nebraska.  This is requested by Wesley H & Mary Ann Damme.

Site is located at 34TH and R Road.

 

Public hearing to approve Tincher-Malzer Subdivision a 4.69 acre tract of land located in the SW ¼ of the SW ¼ of Section 27, T. 8N, R. 14E., of the 6th P.M., Otoe County, Nebraska.  This is requested by Mark Tincher, President of Tincher Investment Co.  & Frank E. Malzer, Pamala S. Malzer, James E. Griepenstroh, Gary L. Malzer, Jean Malzer, Charles Davis, Cheryl Davis, Daborah K. Lurch, and Robert Lurch.

Site is located at 653 S 66th Road

MINUTES AMENDED

August 20th, 2009

SYRACUSE, NEBRASKA

Otoe County Planning Commission met in regular session on August 20, 2009 at the Council Chambers in Syracuse.  The meeting was called to order by Chairperson Daniel Hodges; Hearings were published in the Nebraska City NewsPress.  Answering to roll call: Cheri Wirthele, Loreen Haupt, William Umland, William Behling, and Howard Bebout, and Richard Warner.  Vice – Chairperson Howard Bebout was absent.  Other attendees of this meeting were Zoning Administrator David Schmitz, Dianne Schacht, and ½ ways through the meeting Dan Swanson of the Nebraska City NewsPress came into the meeting.

 

Motion was made by Umland, and seconded by Haupt, with Wirthele, Haupt, Behling, Warner, Hodges voting Aye to approve the minutes of the last meeting.  Motion carried!

 

A Public Hearing to approve the Public hearing to approve W & M Damme Subdivision a 4.86 acre tract of land located in the NW ¼ of the NE ¼ of Section 35, T. 7N., R.11E.  Site is located at 34TH and R Road.  The request is made by Wesley H & Mary Ann Damme for a new home.  Zoning Administrator David Schmitz was there to represent the Damme’s and he addressed the board that this site is about 900 feet from the Osage Church.  The original farmstead is directly south of the new site.  The plan for the driveway is to be accessible from R Road as an alternate.  They would also like to keep the existing driveway so that it is accessible from County Road R.  Schmitz was informed that the driveway access will depend on which way the new house is going to face.  Zoning Administrator Schmitz asked Dianne Schacht if Rural Water goes by the proposed site and she said yes it does.  Schmitz said that he will ask Wesley & Mary Ann if that is their plan.  Warner asked if there are crops currently on it and Zoning Administrator said yes there is.  Motion was made by Haupt to approve the W & M Damme Subdivision, and was seconded by Warner, with Umland, Behling, Hodges, Wirthele, Haupt, and Warner voting aye to approve the W & M Damme Subdivision.  Motion carried!

 

Public Hearing to approve the Tincher-Malzer Subdivision a 4.69 acre tract of land located in the SW ¼ of the SW ¼ of Section 27, T. 8N, R. 14E.  This is requested by Mark Tincher, President of Tincher Investment Co.  & Frank E. Malzer, Pamala S. Malzer, James E. Griepenstroh, Gary L. Malzer, Jean Malzer, Charles Davis, Cheryl Davis, Daborah K. Lurch, and Robert Lurch.  This site is located at 653 S 66th Road.  Representing these owners is Zoning Administrator David Schmitz.  Schmitz discussed with the board that he is having all the owners sign a Notary Disposition form and is waiting on two (2) more signatures from Minnesota.  Schmitz also stated as information for the board that Robert Lurch does no longer need to sign the plat because he is divorced from Deborah Lurch.  This new subdivision will be directly south of the T & M Subdivision.  Schmitz also said that the driveway is going to stay with the acreage, which is included on the subdivision.  There are plenty of other areas to make a drive to get to the farm ground.  Rural Water hook ups are there, and are in use.  The septic system is about 15 years old.  There was a discussion if the people listed on the plat were all owners?  Schmitz said yes with Mark Tincher, President of Tincher Investments owning the majority of the property.  Umland asked if the intent was to separate the farm ground?  Zoning Administrator Schmitz said yes the current renters (Jeremy and Tristin Miller) are planning to purchase and build a home on this 4.69 acre tract.  Motion was made by Warner to approve the TincherMalzer Subdivision, and was seconded by Wirthele, with Umland, Behling, Hodges, Wirthele, Haupt and Warner voting aye to approve the TincherMalzer Subdivision.  Motion carried!

 

Old business discussed at this meeting, was the KYP 3rd Subdivision, Zoning Administrator Schmitz said that the driveway has been approved by both the State and the Otoe County Highway Superintendent Glen Steffensmeier.  But they are still waiting on the report from the DEQ.

 

Under discussion, Zoning Administrator Schmitz wanted to discuss and get the boards opinion on a 2.2 acre tract of ground in the NW part of the county with an existing house and barn on it.  There is a potential buyer for this property and they would like to build a new house on this tract of ground and use the existing house for a Retreat Counseling Center (Life Skills Training Facility).  He also thought that it would be possible to have a special use or possibly use the conditional use #5 or #7.  Umland voiced his opinion and said that they would have to meet all offsets, and that the current owners would have to have a public hearing before the purchase is finalized.  Zoning Administrator said that he thinks that there would be enough room because it is a long area.  There would also have to be restrictions on it and that the original house could not be used as a residence.  Schmitz is not concerned with the current buyers, but if it would ever sell later down the line, how would it be treated?

 

There was a reminder about the Workshop with the Commissioners next Tuesday August 25, 2009 in the County Courtroom.  Possible discussions will be Wind Energy, rezoning of the area south of Palmyra, and whatever other discussions in each district that they would like to address.  Orville Stahr will be there to discuss Wind Energy and regulations and address any questions.

 

There being no further business Chairperson Hodges asked for a motion to adjourn the meeting.  Motion was made by Umland and was seconded by Wirthele, with all members present voting aye to adjourn this meeting.  Meeting was adjourned at 7:37 P.M.  Next regular scheduled meeting will be September 17, 2009 at 7:00 P.M.
