OTOE COUNTY PLANNING COMMISSION MINUTES

SEPTEMBER 17TH, 2009

SYRACUSE, NEBRASKA

 

Otoe County Planning Commission met in regular session on June 18th, 2009 at the Council Chambers in Syracuse.  The meeting was called to order by Vice – Chairperson Howard Bebout; Hearings were published in the Nebraska City Newspress.  This meeting was open to the public, and the Opening Meetings Act is posted on the wall of the Council Chambers.  Answering to roll call was Cherie Wirthele, Loreen Haupt, Richard Warner, William Umland, Bill Behling, and Howard Bebout.  Chairperson Daniel Hodges was absent.  Other attendees of this meeting were Zoning Administrator David Schmitz, Dan Swanson, and David Berner.

 

Behling made a motion, seconded by Wirthele, to approve the August 20th, 2009 minutes.  Voting aye were Umland, Behling, Wirthele, Haupt, Warner, & Bebout. 

Nay – none. Motion Carried.

 

Public hearing to approve Kissinger Subdivision, a 3-acre tract of land located in the

SE ¼ of the SW ¼ of Section 21, T.7., R.9E, of the 6th P.M., Otoe County, Nebraska.  This is requested by Lloyd P. Kissinger. Site is located at 5th and Q Road.  The Zoning Administrator, David Schmitz, was there to represent Lloyd P. and George Kissinger who will be using this 3-acre tract of land for a new home.  Schmitz reported that all regulation reports came back good including the water.  Vice – Chairperson Bebout opened this public hearing to the floor for discussion.  There being no comments from the floor.  Vice – Chairperson Bebout asked for a motion from the board.  Haupt made the motion, seconded by Warner to approve the Kissinger Subdivision.  Voting aye were Behling, Wirthele, Warner, Haupt, Bebout, and Umland.  Nay – none.  Motion carried.

 

Old business matters were addressed at this time.

 

Zoning Administrator Schmitz handed out a report on the proposed wind power regulations to all board members present and reported that there were not many changes since the August 25th, 2009 workshop with the commissioners.  Schmitz pointed out the few changes, and said that Orville Stahr and he had not talked since the workshop, but would be meeting at a later date to discuss more on this subject and in the latter part of the year or early 2010 hold a public meeting.

 

At 7:15 Vice – Chairperson Bebout relinquished the control of the meeting to Chairperson Daniel Hodges.

 

Chairperson Hodges asked if there was any new business at this time.  At this time there was no new business.  Therefore, Chairperson Hodges opened the meeting for discussion on other matters that may need to be discussed. 

 

 

Vice – Chairperson Bebout mentioned a situation that has been brought to his attention about a piece of property that is agriculturally zoned, and there is a sporting event being held there this weekend. There is not a conditional use on file with this piece of property, and is a direct violation.  After continued discussion and review of Zoning Regulations, the board reviewed Article #12 Section 1201-1203 which states that the complaint has to be in writing.  Then the complaint has to be filed with the Zoning Administrator.  The Zoning Administrator shall properly record receipt of such complaint and then immediately investigate the situation, and take appropriate action thereon in accordance with the regulations and requirements of this Resolution.

 

Also, discussed was the Comprehensive Plan.  The Otoe County Planning and Zoning Commission review the comprehensive plan every two years.  The board made a few suggestions but no decisions were made, Zoning Administrator Schmitz and Chairperson Hodges suggested everyone study their regulation books, make notes and bring any question, comments, and concerns to the next meeting for a discussion.

 

Zoning Administrator Schmitz spoke about what David Berner originally had came to him with and then introduced David Berner.  Berner owns a 20-acre tract of land and he would like to cut a 3-acre tract off to be sold.  This was ground where an old school house sat.  He just wanted to know if this would be possible.  After discussion, the board said that he could make one cut and that is all that they would allow.  Therefore, if Berner would like to move forward with this project then he can go ahead and make the necessary arrangements. Berner thanked everyone for the discussion, suggestions and their time.

 

There being no further business, and since all items on the agenda have been discussed.  Chairperson Hodges asked for a motion from the board to adjourn the meeting.  Bebout made the motion, and was seconded by Umland to adjourn the meeting, with all members present voting aye.  Meeting adjourned at 7:52 p.m. 

 

Next regularly scheduled meeting will be October 15th, 2009
