NOTICE IS HEREBY GIVEN that the Regular meeting of the Otoe County Commissioners of Otoe County, Nebraska will be held at 8:30 o’clock a.m. on November 27, 2007, in the County Courtroom (108) of the Otoe County Courthouse.  The meeting will be open to the public.  An agenda for each meeting is kept continuously current, and is available for public inspection at the office of the County Clerk at the Courthouse, but the agenda may be modified at such meetings to include items of an emergency nature only.

NOVEMBER 27, 2007

 

The Otoe County Board of Commissioners convened in regular session at 8:30 a.m. on November 27, 2007 to audit and sign payroll claims and regular claims and to take care of such other matters as are on the agenda for this meeting. Advance notice of this meeting was published in the Nebraska City News Press and Syracuse Journal Democrat, announced on the local radio station KNCY and posted in three public places.  This meeting was open to the Public; the agenda was kept current and is on file for public inspection at the office of the Otoe County Clerk during regular business hours.

 

The meeting was called to order by the Chairman of the Board Joy W Schroder.  Answering present at roll call were Commissioner Schroder, Commissioner Thummel and Commissioner Haverty. None absent.

 

Commissioner Haverty made a motion, seconded by Commissioner Thummel to accept the agenda as posted. Voting -- Commissioners Schroder, aye; Thummel, aye; Haverty, aye. Motion carried.

 

Commissioner Thummel made a motion, seconded by Commissioner Haverty to accept the minutes from the previous meeting as mailed to them and not have them read. Voting – Commissioners Thummel, aye; Haverty, aye; Schroder, aye. Motion carried.

 

Commissioner Thummel made a motion, seconded by Commissioner Haverty to audit and sign payroll claims and regular claims as presented, unless otherwise noted. Voting – Commissioners Haverty, aye; Schroder, aye; Thummel, aye. Motion carried.

 

Chairman Schroder informed the pubic in attendance that a current copy of the Open Meetings Act is posted on the south wall of the Courtroom.  Additional copies are available upon request. He asked that all attendees turn off their cell phones while present in the meeting room.

 

Dave Schmitz, Zoning Administrator, conducted public hearings for approval of the following subdivisions:

  1. South Winds Subdivision, located in the E ½ of the SE ¼ S2-T7-R12: It is a 17.75 acre parcel; Susan Kraft, owner, wants to sell off part of the land.  Commissioner Haverty made a motion seconded by Commissioner Thummel to authorize Chairman Schroder to sign the plat map for South Winds Subdivision.  Voting – Commissioners Schroder, aye; Thummel, aye; Haverty, aye.  Motion carried.
  2. W-T Subdivision located in the NW ¼ of the SE ¼ S29-T7-R13: Harry & Dianne Wieckhorst sold land to Greg Teten several years ago. Teten has lived there all this time, but it was recently discovered that he has been paying taxes on the wrong quarter due to incorrect records at the time of the sale.  2.7 acres were deeded to Teten; however, he is actually using more land than that.  The Wieckhorsts are willing to let him keep the land, but the deed and all county records need to be corrected so that the Wieckhorst’s can sell the rest of the property.  Commissioner Thummel made a motion seconded by Commissioner Haverty to approve the corrections being made and to authorize Chairman Schroder to sign the revised plat for W-T Subdivision.  Voting – Commissioners Thummel, aye; Haverty, aye; Schroder, aye.  Motion carried.
  3. Siepelmeier Subdivision located in the E ½ of the SE ¼ S2-T7-R12 requested by Steven & Sharilee Siepelmeier: Owners are desirous of selling the farmstead as defined by this subdivision.  Motion to sign the plat was made by Commissioner Thummel and seconded by Commissioner Haverty. Voting -- Commissioners Haverty, aye; Schroder, aye; Thummel, aye.  Motion carried.
  4. A Public Hearing to consider issuance of a Conditional Use Permit to WDSS Enterprises to place a Shooting Range and Animal Kennel on property located in the N ½ of the SW ¼ and NE ¼ of the NE ¼ and the S ½ of the NE ¼ and the NW ¼ of the SE ¼ S16-T7-R9 was canceled by the owner of the property on 11-26-07.

 

Other business matters were addressed at this time.

 

At the October 23rd meeting, Carol Bruggeman, the Village Clerk of Dunbar, approached the County Board with a request to have Otoe County administer the Village’s zoning and building inspection services. The Board agreed to accept her request, but asked that she provide an Interlocal Agreement signed by the Dunbar Board of Trustees. Having done so, a motion was made by Commissioner Haverty and seconded by Commissioner Thummel to authorize Chairman Schroder to sign and enter into an Interlocal Agreement with the Village of Dunbar whereby the County will provide zoning and building inspection services to the Village; fees shall be based upon the current Uniform Building Code. Voting – Commissioners Schroder, aye; Thummel, aye; Haverty, aye.  Motion carried.

 

Andrea Walters, County Assessor, presented the following tax list corrections for approval: 1) Southeast Nebraska Grain Company – add a total of $710.42 – centrally assessed property (former railroad right of way) is now being assessed to a private owner. 2) Automotive Inc – add $117.10 – received depreciation schedule after taxes were set resulting in an adjustment.  3) Clay & Dona Sluka Smith – deduct $461.60 – site acres were adjusted after the tax roll was printed. 4) David and Diane Madsen – add $333.18 – discovered that a building was omitted after the tax roll was printed. 5) Myron P Schroder – add $68.80 for tax years 2005-2007 – disqualified from special Greenbelt valuation. Commissioner Haverty made a motion seconded by Commissioner Thummel to approve the tax list corrections as presented.  Voting – Commissioners Thummel, aye; Haverty, aye; Schroder, aye.  Motion carried.

 

A resolution to support the concept of establishing Sunrise EquiTherapy was discussed. Its mission is to provide equine oriented activities for individuals of all ages with physical and mental disabilities. In order to qualify for a federal aid grant, a resolution is needed supporting the benefits of equine therapy. Commissioner Haverty made a motion seconded by Commissioner Thummel to sign Resolution 2007-41 supporting the benefits of equine therapy to the residents of Otoe County.  Voting -- Commissioners Thummel, aye; Haverty, aye; Schroder, Aye.  Motion carried.

 

At 9:20 a.m. Commissioner Haverty made a motion, seconded by Commissioner Thummel to go into executive session to discuss general assistance cases/application with Marv Pesek, GA Administrator.  Voting – Commissioners Haverty, aye; Schroder, aye; Thummel, aye. Motion carried.

 

At 9:35 a.m. Commissioner Haverty made a motion seconded by Commissioner Thummel to go back into regular session.  Voting –Commissioners Schroder, aye; Thummel, aye; Haverty, aye. Motion carried. No action was taken while in executive session.

 

Glen Steffensmeier, Highway Superintendent, and Wally Pohlman and Rich Kuenning, Road Foremen, came before the Board to discuss road and bridge issues.

 

Steffensmeier said that he has completed about one half of the bridge inspections. He closed Bridge #12935 after finding areas with significant damage.  It is an old truss bridge located on N 28th Rd between Roads A and B. The NRCS office in Syracuse has a lot of people wanting to build and replace terraces which will affect road ditches due to the drainage.  The NRCS office will notify Steffensmeier when terrace work is approved so he can monitor the drainage of the terraces to prevent erosion problems.  The Otoe shed is now getting power run up to the building.  Steffensmeier stated that he needs a place to take old bridge timbers.  Currently they just lay them in the ditches creating a hazard to anyone walking in that area due to spikes sticking out.  The Palmyra federal aid bridge was discussed and they may be pouring concrete soon if the weather holds. 

 

Rena Pugh with SENCA came to the meeting to introduce herself since she is a new employee.  She is busy organizing efforts to provide food and Christmas gifts for needy families.  She has placed a Christmas tree at Pamida for donations. 

 

Jim Johnston & John Palmtag made a recommendation for Mary Coleman to be appointed as a new member on the Otoe County Visitors Committee, replacing Rose Garey who resigned.  Commissioner Haverty made a motion seconded by Commissioner Thummel to appoint Mary Coleman to serve as a member of the Otoe County Visitors Committee.  Voting –Commissioners Thummel, aye; Haverty, aye; Schroder, aye.  Motion carried.   

 

There being no further business to come before the Board at this time, and since all items on the agenda have been disposed of, Commissioner Haverty made a motion, seconded by Commissioner Thummel to declare this meeting adjourned, until the next one, which will be on December 11, 2007. Voting – Commissioners Thummel, aye; Haverty, aye; Schroder, aye. Motion carried.
